Terms and conditions relating to the sale of wine listed on this web site1. Orders for wine listed on this web site may be given by telephone, mail, e-mail or fax. No guarantee is given that a wine listed is available since stocks change on a continuing basis. On receipt of an order we will check that wine in the required quantity is available and then at our discretion either confirm or decline the order in writing or electronically. The terms and conditions specified below on the date of receipt of an order which is confirmed apply to that order. Those terms and conditions are subject to English law. 2. There will be no contract between us and wine ordered will not be despatched until payment has been made by either credit or debit card. 3. The prices given on this web site include tax and duty but not delivery charges, unless otherwise stated. Delivery will be made only to an address within the United Kingdom. The charge for delivery will be quoted to you before the order is confirmed and the order will not be confirmed until you have approved the charge. Unless we are prevented from doing so by circumstances which are beyond our control we will dispatch wine ordered within * days of receiving payment for it. 4. You have a statutory right to cancel your order within seven days of the date of delivery. You may do this by giving us notice before the expiry of the seven day period. You may leave the notice at or post it to the address given below or fax or e-mail it to the number or e-mail address given below. The notice is treated as having been given on the date on it is left, posted or sent. If you cancel your order in exercise of your statutory right, you must at your own expense return the wine supplied to the address given below within seven days, failing which a charge will be made for its collection. Subject to this, if you cancel your order we will refund in full the cost of the order. 5. If despite condition 2 we dispatch wine to you before payment is received, a contract between us will be established by the dispatch and we will retain title to the wine until payment is received. Risk in the wine will pass to you on its delivery to the address specified by you. 6. If wine delivered to you is in any way not satisfactory by reason of breakage, its condition or otherwise you must within seven days of delivery notify us accordingly and make the wine in question available for collection. Failing this, you will have no right to reject the wine. 7. We purchase wine only from sources which we believe to be reliable and make every effort to ensure that our storage facilities are appropriate. If wine is considered by you not to be in good condition we will if we if we share your opinion take back any unopened bottles. However, we will not do this if you have held the wine for long enough to enable it to deteriorate during your period of ownership. |
